Hukuk Dairesi 23.06.2020 tarih, 2019\/6040 Esas ve 2020\/2070 Say\u0131l\u0131 Karar\u0131nda \u00f6zetle; <\/strong><\/p>\n<p>Davac\u0131 vekili taraf\u0131ndan mahkememize verilen dava dilek\u00e7esinde; m\u00fcvekkilinin \u0130stanbul ili, &#8230; il\u00e7esi, &#8230; mahallesi, &#8230; mevkii, 662 ada, 22 parsel, 25 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn maliki oldu\u011funu, ayn\u0131 parselde &#8230;\u2019\u0131n 29 numaral\u0131 dairenin maliki oldu\u011funu, bu ki\u015finin &#8230; ile yapt\u0131\u011f\u0131 kredi s\u00f6zle\u015fmesi ile 29 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm \u00fczerine ipotek \u015ferhi i\u015flendi\u011fini, ipotek borcu \u00f6denmedi\u011finden gayrimenkul\u00fcn sat\u0131ld\u0131\u011f\u0131n\u0131, ipotekli ta\u015f\u0131maz i\u00e7in 2 ayr\u0131 k\u0131ymet takdiri raporu bulundu\u011funu, bu raporlardan da anla\u015f\u0131laca\u011f\u0131 \u00fczere bir ta\u015f\u0131nmaza ait daire numaras\u0131nda bir yanl\u0131\u015fl\u0131k olsa dahi bu yanl\u0131\u015fl\u0131\u011f\u0131 gidermenin icra hukuk mahkemesi ya da icra m\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn g\u00f6rev alan\u0131nda olmad\u0131\u011f\u0131n\u0131 ancak icra m\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn 29 numaras\u0131 yerine 25 numara ibaresini yazmakla sorunu \u00e7\u00f6z\u00fcm\u00fc yoluna gitti\u011fini ancak, bu hukuksuz uygulama kar\u015f\u0131s\u0131nda m\u00fcvekkilinin ma\u011fdur edildi\u011fini, hukuken yap\u0131lmas\u0131 gereken daval\u0131 taraf\u00e7a bu yanl\u0131\u015fl\u0131\u011f\u0131n giderilmesi i\u00e7in genel mahkemelerde dava a\u00e7\u0131lmas\u0131 gerekirken icra m\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn takdiri ile m\u00fcvekkilinin ma\u011fdur edildi\u011fini, m\u00fcvekkiline ait dairenin tahliye edilmesi halinde telafisi m\u00fcmk\u00fcn olmayan kay\u0131plar ya\u015fanaca\u011f\u0131ndan m\u00fcvekkiline ait 25 numaral\u0131 dairenin tahliyesinin durdurulmas\u0131 y\u00f6n\u00fcnde tedbir verilmesini, m\u00fcvekkilinin 25 numaral\u0131 dairenin maliki oldu\u011funu, oysa ki ihalesi yap\u0131lan bor\u00e7lu dairenin 29 numaral\u0131 daire oldu\u011funu b\u00f6ylelikle m\u00fcvekkiline g\u00f6nderilen tahliye emrinin iptaline karar verilmesini talep etmi\u015ftir.<\/p>\n<p>Mahkemece, kap\u0131 numaras\u0131n\u0131n tespit edilmesi y\u00f6n\u00fcndeki talep dava konusu edildi\u011finden, bu hususun esastan de\u011fil, de\u011fi\u015fik i\u015ften g\u00f6r\u00fclebilece\u011fi gerek\u00e7esiyle talebin reddine, tahliye emrinin iptali talebi y\u00f6n\u00fcnden ise mahkemenin g\u00f6revsizli\u011fine karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 &#8230; vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>H\u00fckm\u00fcn temyizi \u00fczerine, Dairemizin 06\/12\/2017g\u00fcn ve 2017\/4132 E.- 2017\/10243 K.say\u0131l\u0131 ilam\u0131 ile, \u201c634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanununun Ek- 1. maddesinde, bu Kanunun uygulanmas\u0131ndan do\u011facak her t\u00fcrl\u00fc anla\u015fmazl\u0131\u011f\u0131n sulh hukuk mahkemesinde \u00e7\u00f6z\u00fcmlenece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. Dava Kat M\u00fclkiyeti Kanunu uyar\u0131nca ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn ana ta\u015f\u0131nmaz\u0131n mimari projesine uygun olarak tahsis edilip edilmedi\u011fine y\u00f6nelik olup, projede ve ta\u015f\u0131nmazda 29 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn fiiliyatta mevcut olup olmad\u0131\u011f\u0131n\u0131n tespiti ve bu konuda 25 numaral\u0131 dairenin tahliye emrinin iptaline y\u00f6nelik olup, Kat M\u00fclkiyeti Kanununa tabidir.<\/p>\n<p>Somut olayda, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin numaralar\u0131n\u0131n onayl\u0131 mimari projeye ayk\u0131r\u0131 olarak tapuda farkl\u0131 yaz\u0131ld\u0131\u011f\u0131 iddia edildi\u011fine g\u00f6re, davac\u0131n\u0131n hukuki yarar\u0131 bulunmakta olup mahkemece, taraflar\u0131n iddia ve savunmalar\u0131n\u0131n mimari proje, y\u00f6netim plan\u0131 ve Kat M\u00fclkiyeti Kanunu h\u00fck\u00fcmleri gere\u011fince incelenerek uzman bilirki\u015fiden h\u00fck\u00fcm kurmaya elveri\u015fli rapor ald\u0131r\u0131larak, sonuca g\u00f6re karar verilmesi gerekirken, de\u011fi\u015fik gerek\u00e7elerle yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi isabetsiz\u201d oldu\u011fu gerek\u00e7esi ile h\u00fckm\u00fcn bozulmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>Mahkemece bozma ilam\u0131na uyularak yap\u0131lan yarg\u0131lamada, \u201cDavac\u0131n\u0131n tespit ve tahliye emrinin iptali taleplerinin ayr\u0131 ayr\u0131 reddine\u201d karar verilmi\u015ftir. H\u00fck\u00fcm, davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>Dosyan\u0131n incelenmesinde: ana ta\u015f\u0131nmaz\u0131n 4 kat bodrum, zemin kat ve 6 normal kat olarak projelendirildi\u011fi, dava d\u0131\u015f\u0131 kat malikinin borcundan dolay\u0131 ana ta\u015f\u0131nmaz\u0131n tapu kayd\u0131na g\u00f6re 29 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn icra suretiyle sat\u0131\u015f\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131,<\/p>\n<p>Sat\u0131\u015f i\u015flemleri a\u015famas\u0131nda al\u0131nan ilk k\u0131ymet takdir raporunda, 29 nolu dairenin yap\u0131lmam\u0131\u015f oldu\u011funun belirtildi\u011fi ve arsa pay\u0131 \u00fczerinden 30.000,00TL k\u0131ymet takdir edildi\u011fi,<\/p>\n<p>\u0130tiraz \u00fczerine al\u0131nan ikinci k\u0131ymet takdiri raporunda ise fiilen 29 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn bulunup bulunmad\u0131\u011f\u0131 a\u00e7\u0131klanmadan 29 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme 70.000,00TL k\u0131ymet takdir edildi\u011fi, sat\u0131\u015f\u0131n bu de\u011fer \u00fczerinden y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc ve yap\u0131ld\u0131\u011f\u0131,<\/p>\n<p>21.01.2013 tarihli 1. sat\u0131\u015f ilan\u0131nda, 28.02.2013 tarihinde birinci, 28.03.2013 tarihinde ikinci sat\u0131\u015f\u0131n yap\u0131laca\u011f\u0131, sat\u0131\u015f ilan\u0131nda ise \u201c6.kat in\u015fa edilmemi\u015f\u201d oldu\u011funun belirtildi\u011fi, al\u0131c\u0131 \u00e7\u0131kmamas\u0131 \u00fczerine sat\u0131\u015f\u0131n d\u00fc\u015ft\u00fc\u011f\u00fc, 26.11.2013 tarihli 2. sat\u0131\u015f ilan\u0131nda ise 30.01.2014 tarihinde birinci, 25.02.2014 tarihinde ikinci sat\u0131\u015f\u0131n yap\u0131laca\u011f\u0131, sat\u0131\u015f ilan\u0131nda ise \u201c\u00e7at\u0131 kat\u0131 yap\u0131lmam\u0131\u015f 6.normal katta kalan k\u0131s\u0131m in\u015faat halinde\u201d yaz\u0131lm\u0131\u015f oldu\u011fu, ta\u015f\u0131nmaz\u0131n alaca\u011f\u0131 devralan alacakl\u0131ya alaca\u011f\u0131na mahsuben 60.000,00TL bedelle 30.01.2014 tarihlinde ihale edildi\u011fi,<\/p>\n<p>Davac\u0131n\u0131n dava konusu gerek\u00e7elerle ihalenin feshi davas\u0131 a\u00e7t\u0131\u011f\u0131, mahkemece aktif husumet yoklu\u011fundan davan\u0131n reddine karar verildi\u011fi,<\/p>\n<p>Yine davac\u0131 taraf\u0131ndan icra i\u015flemlerine y\u00f6nelik \u015fikayet yap\u0131ld\u0131\u011f\u0131, mahkemece al\u0131nan bilirki\u015fi raporunda fiiliyatta 1. bodrum kat\u0131ndaki 4 adet dairenin yap\u0131lmad\u0131\u011f\u0131, projede 1. bodrum kattan ba\u015flayan numaralar\u0131n 6.katta 32 numarada bitti\u011fi, oysa ana ta\u015f\u0131nmazda numaralaman\u0131n zeminden ba\u015flad\u0131\u011f\u0131 i\u00e7in 28 numarada bitti\u011fi, bu nedenle tapudaki 29 nolu dairenin, 25 kap\u0131 nolu daire oldu\u011fu, tapudaki 25 nolu dairenin de 21 kap\u0131 nolu daire oldu\u011funun belirtildi\u011fi, mahkemece \u015fikayetin bilirki\u015fi raporuna g\u00f6re reddine karar verildi\u011fi, Dava dosyas\u0131nda al\u0131nan bilirki\u015fi raporlar\u0131nda ise, 1 projeye g\u00f6re 1. bodrum kat\u0131ndan bina giri\u015finin oldu\u011fu, fiilen bina giri\u015finin 1. bodrum kat\u0131ndan yap\u0131ld\u0131\u011f\u0131, projede var olan 1. bodrum kat\u0131ndaki 4 adet dairenin fiilen yap\u0131lmad\u0131\u011f\u0131, numaralaman\u0131n projede ve tapuda 1. bodrumda yap\u0131lmayan bu dairelerden ba\u015flad\u0131\u011f\u0131 halde fiilen ta\u015f\u0131nmazda zemin kat\u0131ndan ba\u015flad\u0131\u011f\u0131, projede 29 nolu dairenin 6.katta, 25 nolu dairenin ise 5. katta oldu\u011fu, oysa fiilen 25 nolu dairenin en \u00fcst katta yer ald\u0131\u011f\u0131, dolay\u0131s\u0131 ile 1. bodrum kattaki 4 adet dairenin olmad\u0131\u011f\u0131, 6. katt\u0131n oldu\u011fu ancak \u00e7at\u0131 kat\u0131n\u0131n olmad\u0131\u011f\u0131, proje ve tapudaki 29 nolu dairenin fiilen 25 kap\u0131 nolu daire, yine proje ve tapudaki 25 nolu dairenin ise 21 kap\u0131 nolu daire oldu\u011funun belirtildi\u011fi,<\/p>\n<p>Davac\u0131n\u0131n m\u00fcracaat\u0131 \u00fczerine, &#8230; Belediye Ba\u015fkanl\u0131\u011f\u0131n\u0131n 05.06.2018 tarihli cevabi yaz\u0131s\u0131nda, ta\u015f\u0131nmazda fiziki yap\u0131lan incelemede A Blok 4 bodrum kat, zemin kat ve 5 normal kat olarak yap\u0131lm\u0131\u015ft\u0131r, ruhsat ve eki mimari projeye g\u00f6re 29 no in\u015fa edilmemi\u015ftir, bilgisinin yer ald\u0131\u011f\u0131, Davac\u0131 taraf\u0131ndan <strong>uzman g\u00f6r\u00fc\u015f\u00fc<\/strong> olarak al\u0131nan raporda da numaralaman\u0131n do\u011fru oldu\u011fu, 6. kat\u0131n yap\u0131lmam\u0131\u015f oldu\u011funun belirtildi\u011fi,<\/p>\n<p>A\u00e7\u0131klanan bilirki\u015fi raporlar\u0131na g\u00f6re davan\u0131n reddi halinde ana ta\u015f\u0131nmazda ki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliklerinin tamam\u0131n\u0131n ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerinin yerinin de\u011fi\u015fmesinin s\u00f6z konusu olaca\u011f\u0131, bu nedenle de t\u00fcm kat maliklerinin hukukunu do\u011frudan etkilenece\u011fi, dosya i\u00e7erisinde ise ana ta\u015f\u0131nmaza ait t\u00fcm ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri g\u00f6sterir tapu kay\u0131tlar\u0131, y\u00f6netim plan\u0131, kat irtifak\u0131n\u0131n kurulu\u015funa esas ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm listesi ile di\u011fer bilgi ve belgelerin ve t\u00fcm ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin yap\u0131 kullanma izin belgesinin bulunmad\u0131\u011f\u0131, <strong>mahkemece al\u0131nan bilirki\u015fi raporlar\u0131na g\u00f6re<\/strong> davan\u0131n reddine karar verildi\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>1-Dava, ana ta\u015f\u0131nmazdaki t\u00fcm kat maliklerinin hukukunu do\u011frudan etkileyece\u011fine g\u00f6re, t\u00fcm kat maliklerinin davaya dahil edilerek yarg\u0131lama yap\u0131lmas\u0131 gerekirken, taraf te\u015fkili sa\u011flanmadan yarg\u0131lama yap\u0131larak h\u00fck\u00fcm kurulmas\u0131,<\/p>\n<p>2-Ana ta\u015f\u0131nmaza ait t\u00fcm ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ilk tescilinden itibaren maliklerini g\u00f6sterir tapu kay\u0131tlar\u0131 ile y\u00f6netim plan\u0131, kat irtifak\u0131n\u0131n kurulu\u015funa esas ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm listesi ve di\u011fer bilgi ve belgelerin, t\u00fcm ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin yap\u0131 kullanma izin belgesinin ve imar durumunun getirtilerek yap\u0131lacak inceleme ile denetime elveri\u015fli h\u00fck\u00fcm kurulmas\u0131 gerekti\u011finin d\u00fc\u015f\u00fcn\u00fclmemesi,<\/p>\n<p>3-Bilirki\u015fi raporlar\u0131nda, mimari projede yer ald\u0131\u011f\u0131 \u015fekilde 4. bodrum kattan itibaren projede yer alan her bir kat\u0131n tek tek yerinde fiilen incelenip krokiye ba\u011flanmad\u0131\u011f\u0131 gibi dava konusu 29 ve 25 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin projedeki ve fiilen bulundu\u011fu duruma g\u00f6re (m2 \u00f6l\u00e7\u00fcmleri y\u00f6n\u00fcnden de) kar\u015f\u0131la\u015ft\u0131rmal\u0131 bir tespitin yap\u0131lmad\u0131\u011f\u0131, belediye taraf\u0131ndan yap\u0131 kullanma izin belgesinin hangi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme verildi\u011fi veya verilmedi\u011finin tespit edilmedi\u011fi, hangi kat ve katlar\u0131n ( bu nedenle ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn) projeye ayk\u0131r\u0131 yap\u0131lmad\u0131\u011f\u0131, di\u011fer bir deyi\u015f ile dava konusu 29 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn fiilen 25 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm olup olmad\u0131\u011f\u0131n\u0131n ku\u015fkuya yer vermeyecek \u015fekilde tespitinin (<strong>eksik inceleme, \u00e7eli\u015fkili raporlar<\/strong> ve belediye yaz\u0131s\u0131 gibi) dosya kapsam\u0131ndan belirlenemedi\u011fi halde, <strong>h\u00fck\u00fcm kurmaya elveri\u015fsiz raporlara g\u00f6re karar verilmesi, do\u011fru g\u00f6r\u00fclmemi\u015ftir.<\/strong><\/p>\n<p>Mahkemece, yukar\u0131da belirtilen bilgi ve belgeler ile tapu ve belediye ba\u015fkanl\u0131\u011f\u0131ndan <strong>mimari projeler, imar durumu, yap\u0131 kullanma izin belgelerinin verilmesine ili\u015fkin t\u00fcm bilgi ve belgeler dosya i\u00e7erisine al\u0131nd\u0131ktan sonra belediye ile kat irtifak\u0131n\u0131n kurulu\u015funa esas tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne sunulan projeler aras\u0131nda farkl\u0131l\u0131k olup olmad\u0131\u011f\u0131, tadilat projesi bulunup bulunmad\u0131\u011f\u0131 da ara\u015ft\u0131r\u0131l\u0131p<\/strong>, konusunda <strong>uzman bilirki\u015fi heyeti<\/strong> ile yerinde yap\u0131lacak inceleme sonucu al\u0131nacak raporla, gayrimenkul sat\u0131\u015f dosyas\u0131 ve taraflar\u0131n t\u00fcm delilleri birlikte incelenerek olu\u015facak izin belgelerinin durumu net olarak belirlenememi\u015ftir. Bu sebeple, mahkemece tapu ve belediye ba\u015fkanl\u0131\u011f\u0131ndan gerekli bilgi ve belgelerin temin edilmesi, <strong>uzman bilirki\u015fi heyeti<\/strong> ile yerinde ke\u015fif yap\u0131lmas\u0131 ve taraflar\u0131n delillerinin de\u011ferlendirilmesi gerekmektedir. B\u00f6ylece, gayrimenkul sat\u0131\u015f dosyas\u0131 ile projeler aras\u0131ndaki farkl\u0131l\u0131klar\u0131n ortaya \u00e7\u0131kar\u0131lmas\u0131 ve dava konusu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ger\u00e7ek durumunun tespit edilmesi m\u00fcmk\u00fcn olaca\u011f\u0131 gerek\u00e7esiyle bozma karar\u0131 verilmi\u015ftir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yarg\u0131tay 20.
